Should you wish to register .hamburg names with us or transfer .hamburg names to our management, the Registry Operator, Hamburg Top-Level-Domain GmbH, imposes certain conditions. As set out in our Terms and Conditions, by placing an order with us you unconditionally agree to be bound by these conditions as follows:

  1. Registrant consents to the collection and use of Personal Data by the Registry Operator for the purposes of providing Registry Services as defined in ICANN’s Registry Agreement (including but not limited to publication of registration data in the directory services, also known as “Whois” or “RDDS”)
  2. Registrant accepts and agrees to abide by the Registry Policies as amended from time to time.
  3. Registrant acknowledges and agrees that it is fully responsible for the registration and use of the registered Domain name
  4. Registrant shall indemnify, to the maximum extent permitted by Law, defend and hold harmless the Registry Operator, Registry Operator’s service providers, Registry Operator shareholders and Registry Operator directors, officers and employees and agents from and against any claim, damages, liabilities, costs and expenses (including reasonable lawyer fees) arising out of or relating to Registrant’s Domain Name registrations and/or use.
  5. Registrant accepts and acknowledges that Registry Operator reserves the right to change the status of the relevant Domain Name(s) during the resolution of a dispute, a compliance procedure, upon a request from a competent authority (e.g. put on hold, lock as well as to deny, modify, cancel, suspend, or transfer any registration that it deems necessary, in its complete discretion in order to:
    1. protect the integrity, security, and stability of the Registry System;
    2. comply with all appropriate laws, government rules or requirements, requests of law enforcement or any other relevant authority, or in compliance with any dispute resolution process;
    3. avoid any liability of Registry Operator, its affiliates, shareholders, subsidiaries, officers, directors, and employees;
    4. stop or prevent any violations of any terms and conditions of this Agreement;
    5. correct mistakes made by Registry Operator, Registry Operator service providers or any registrar in relation to a Domain Name registration;
    6. and ensure compliance with ICANN and/or Registry Policies.
  6. Registrant shall immediately correct and update the registration information for the registered name during the registration term.
  7. Registrant shall comply with and adhere to all applicable ICANN Policies and Registry Policies for resolution of disputes concerning Domain Names.
  1. Registrant is prohibited from distributing malware, abusively operating botnets, phishing, piracy, trademark or copyright infringement, fraudulent or deceptive practices, counterfeiting, or otherwise engaging in any activity contrary to any Applicable Laws. A consequence for participation in such activities includes suspension of the Domain Name.
  2. Registrant represents that it possesses any necessary authorisations, charters, licenses and/or other related credentials for participation in the sector associated with the .hamburg.
  3. Registrant shall report any material changes to the validity of Registrant’s authorisations, charters, licenses and/or other related credentials for participation in the sector associated with the TLD.
  4. Registrant acknowledges and accepts that if it is using a proxy, privacy, and/or a third- party service to register a Domain Name on behalf of Registrant, the proxy, privacy, and/or third party service provider is deemed to be the Registrant and any actions and/or inactions that are in violation of any applicable policies, rules, procedures, terms, conditions, regulations, and Applicable Laws are the responsibility of the Registrant.
  5. Registrant acknowledges that Registry Operator is a third party beneficiary of these Terms and Conditions and is entitled to enforce its rights vested by the Terms and Conditions. The rights in or issues vested in Registry Operator as beneficiary of the Terms and Conditions shall survive the termination or expiration of said Terms and Conditions.

Registry Operator imposes the following obligations upon resellers of Registry Operator’s domain names:

  1. Reseller agrees to, is bound by, and will comply with all obligations applicable to Reseller in this Agreement.
  2. Resellers shall fully defend, indemnify and hold harmless Registry Operator, and Registry Operator members, officers, directors, agents, employees, and subcontractors for any loss, liabilities, damages, costs or expenses, including reasonable attorneys’ fees, resulting from any third party claim, action, or demand arising out any dispute in relation to any Domain Name registered by Registrant’s Resellers in the Registry System, including but not limited to disputes arising out of Reseller’s non-compliance with any Registry Policies, ICANN Policies, any terms and conditions of any of the applicable obligations under this Agreement, any Applicable Laws, and/or Reseller’s infringement of third-party rights, unless the Registrar can evidence not to have acted negligently.
